When a Dutch court rejected a crypto exchange management's proposal to self-distribute client funds, the market didn't blink. It should have. The court found a 7 million euro deficit—funds that should have been in the foundation's accounts but weren't. Then the Dutch Fiscal Information and Investigation Service (FIOD) launched a criminal investigation.

Knaken had not obtained authorization from the Dutch Authority for the Financial Markets (AFM). Under current Dutch law—unlike the forthcoming MiCA regulations—there is no automatic legal segregation of client assets. The foundation structure provided no real protection.
